PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE USING THE KWIKFIT WELKOM WEBSITE OR ENGAGING IN ANY TRANSACTION WITH KWIKFIT WELKOM.
By accessing, browsing, registering, or transacting on the Kwikfit Welkom website, you confirm that you fully understand, accept, and agree to be bound by these Terms & Conditions.
If you do not agree, you may not use the website or trade with Kwikfit Welkom.
Throughout these Terms & Conditions, the terms “Customer”, “User”, “You”, or “Your” refer to any person or entity interacting with Kwikfit Welkom or making use of the Kwikfit Welkom website in any way.
1. Services Offered
The Kwikfit Welkom website provides information about, and facilitates transactions for, our products and services. These include, but are not limited to: a tyre fitment centre offering complete tyre and wheel solutions, supply and fitment of tyres for all vehicles (passenger, industrial, etc.), alloy rims, wheel balancing, wheel alignment, puncture repairs, and batteries.
2. Website Registration
- Creating an online account is free and optional, but an account must be created before any online purchase may be completed.
- When registering an account, you must provide accurate, complete, and truthful information.
- All personal details are protected under our Privacy Policy.
- Any activity performed under the correct username and password will be treated as authorised by you.
- You agree to notify Kwikfit Welkom immediately if you suspect any unauthorised use of your account.
2. Use of the Website
You agree that:
- You are solely responsible for all activity performed through your account.
- You will not attempt to interfere with the website’s functionality or security.
- You will not copy, distribute, publish, or use website content without written permission from Kwikfit Welkom.
- You may not upload or distribute unlawful, offensive, harmful, or malicious material.
Kwikfit Welkom accepts no liability for losses resulting from misuse of the website.
3. Customer Obligations
You warrant that:
- All information you provide is correct, lawful, and not misleading.
- You will not upload harmful data or transmit defamatory or fraudulent content.
- You will only place orders that you are able and willing to pay for.
- You agree to follow these Terms & Conditions and all other relevant Kwikfit Welkom policies(including the Returns Policy and Privacy Policy).
4. Orders & Products
Kwikfit Welkom may accept, amend, or reject an order at its discretion. Decisions may depend on:
- Stock availability
- Accurate product and price information
- Successful payment
- Any breach of these Terms
Additional important points:
- Saved carts do not reserve stock or pricing.
- Once an order is submitted and paid for, it is binding and cannot be cancelled.
- Stock is not guaranteed.
- Kwikfit Welkom may ship orders from any of its dispatch points.
- Online prices may differ from in-store prices.
- Product images on the website or social media may differ from the actual item supplied.
- Payment must be made in full before goods are released or services rendered, unless otherwise agreed in writing.
5. Returns Policy
Kwikfit Welkom operates a strict returns policy:
5.1 General Rule
“All sales are final.”
Items may not be returned or exchanged unless the product is defective and still in unused, original condition.
5.2 If a Return Is Accepted
- No refunds will be issued.
- Returns approved by Kwikfit Welkom qualify for store credit or replacement only, excluding shipping fees.
- Items must be unused, in original packaging, with labels intact.
- Kwikfit Welkom will inspect all returned items.
- Return approval is at Kwikfit Welkom’s sole discretion.
5.3 Defective Items
- All claims must be submitted by email ONLY with clear photos.
- Missing info may result in claim dismissal.
- Evaluation results are final.
- If a defect claim is approved, Kwikfit Welkom will cover the cost of return shipping. If rejected, the customer bears the cost.
5.4 No Statutory Cooling-Off Rights –
The Customer acknowledges and agrees that, due to the nature of the goods sold (specifically, tyres and associated automotive parts which may be tailored to vehicle specifications and are hygiene-sensitive if fitted), the transaction is exempt from, and the Customer expressly waives, any statutory right to cancel the sale or return the goods under a 'cooling-off' period as may be provided for in applicable legislation, including the Consumer Protection Act, 2008. All sales are final upon completion of payment.
6. Price Policy
- Prices are subject to change without notice.
- Pricing applies to the Unit of Measure (UOM) shown.
- Prices include VAT unless stated otherwise.
- Transport, insurance, and fitment charges are excluded unless agreed in writing.
- Only one promotion may be redeemed per sale unless otherwise stated.
- Online prices may vary from in-store pricing.
7. Delivery Options
Kwikfit Welkom offers:
- In-store collection
- Fitment at Kwikfit Welkom
- Courier delivery nationwide
You accept that:
- Delivery addresses must be correct and updated by you.
- Delivery may be refused for unsafe, unreachable, or restricted locations.
· Title (ownership) of the goods shall remain with Kwikfit Welkom until the purchase price has been paid in full. Risk in the goods, however, shall pass to the Customer upon delivery to the Customer or to a third-party carrier nominated by Kwikfit Welkom for shipment to the Customer. The Customer is responsible for insuring the goods from the moment risk passes.
- Delays do not entitle the customer to cancel, withhold payment, or claim damages.
- Delivery times are estimates only and not guaranteed.
- Risk passes to the customer upon collection or delivery.
- Courier delays are outside the control of Kwikfit Welkom.
- Fitment and on-site services:
o Customers are required to remain on site while vehicles are being serviced.
o Customers must retain possession of their vehicle keys at all times while on the premises.
o Vehicles left unattended are entirely at the customer’s own risk.
o Kwikfit Welkom shall not be liable for loss, theft, or damage to vehicles or personal belongings..
Kwikfit Welkom may charge additional delivery or storage fees if the customer fails to accept delivery.
Claims for missing or damaged items must be reported immediately on delivery.
8. Warranty
- Kwikfit Welkom provides no additional warranty beyond that of the product manufacturer.
- Warranty claims must follow the defective-item claims process.
- Liability is limited strictly to repair or replacement as determined by the manufacturer.
9. Customer Default
If you breach these Terms, Kwikfit Welkom may:
- Suspend your account or trading ability
- Cancel orders
- Reverse discounts
- Demand immediate payment
- Take legal action to recover outstanding amounts
All collections and legal fees will be payable by the customer.
10. Errors & Omissions
Kwikfit Welkom will take reasonable care to ensure correct website information.
However, typing errors, incorrect pricing, or product description mistakes may occur.
Kwikfit Welkom reserves the right to:
- Cancel affected orders
- Correct inaccurate information
- Refund payments where applicable
10.1 New Website Disclaimer
Kwikfit Welkom is a newly launched online platform. Product information, pricing, availability, functionality, and service offerings may be updated, corrected, or modified as the website and systems are further developed and improved. Kwikfit Welkom shall not be held liable for any discrepancies arising during this ongoing improvement process.
11. Availability & Termination
Kwikfit Welkom may suspend, modify, or discontinue website services at any time without liability.
Failure to comply with these Terms may result in account suspension.
12. Electronic Instructions – Waiver & Indemnity
You acknowledge the risks of sending electronic instructions and agree that:
- Kwikfit Welkom may rely on any instruction sent from your registered email/account.
- You indemnify Kwikfit Welkom against losses arising from forged, misdirected, or unauthorised electronic communications.
13. Privacy Policy
Kwikfit Welkom will protect customer information per the Promotion of Access to Information Act (PAIA).
Personal information will not be shared except where legally required.
14. Payment
- Payments may be made via Visa or MasterCard.
- Online payments are securely processed via PayFast and Netcash. Kwik Fit Welkom does not store card details and accepts no liability for payment processing errors beyond its control.
- Customer information is stored separately from card details.
15. Country & Governing Law
All transactions occur in South Africa.
All payments are processed in South African Rand (ZAR).
These Terms are governed by South African law.
16. Kwikfit Welkom’s Responsibility
Kwikfit Welkom is responsible for:
- Supplying goods as advertised
- Customer service
- Delivery arrangements
- Handling disputes where applicable
17. Variations
Kwikfit Welkom may update these Terms & Conditions at any time.
Continued use of the website constitutes acceptance of updated terms.
18. Promotions, Competitions & Giveaways
From time to time, Kwik Fit Welkom may run promotions, competitions, or giveaways. Participation in any such promotion is entirely voluntary and at the customer’s own risk.
By entering or participating, the customer agrees to be bound by any terms, conditions, instructions, or rules that are communicated at the time of the promotion, whether published on the website, social media platforms, in-store, or through any other communication channel.
Kwik Fit Welkom reserves the right to amend, suspend, withdraw, or terminate any promotion, competition, or giveaway at any time, without prior notice and without any liability.
Unless otherwise stated, no cash alternatives will be offered, and prizes are non-transferable and non-exchangeable.
Kwik Fit Welkom’s decisions regarding any promotion, competition, or giveaway are final, and no correspondence will be entered into.
19. Severability
If any provision of these Terms & Conditions is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions.
19. Intellectual Property
All content, trademark’s, and materials remain the property of Kwikfit Welkom and may not be used without written consent.
20. Limitation of Liability
Kwikfit Welkom and its directors, employees, partners, agents, suppliers, or affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
· Your access to or use of or inability to access or use the website;
· Any content obtained from the website; and
· Unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.
21. Force Majeure
Kwikfit Welkom shall not be liable for failure to perform due to events beyond its’ reasonable control.
